Do I Need a Prenuptial (Premarital) Agreement?

Determining the need for a premarital agreement represents a highly personal decision for couples heading to the altar. When young couples plan a first marriage and have relatively few assets or other special circumstances, drafting such a contract prior to marriage can potentially create conflict. But if an imbalance of wealth exists prior to the marriage, or if you have children or a business needing protection, a premarital agreement can represent a virtual requirement. A frank discussion with experienced Utah family lawyers can help you assess the pros and cons of negotiating certain terms before you get married.

If you are considering a prenuptial agreement, you should be aware of the Utah Uniform Premarital Agreement Act.  This section of the Act identifies the items that you can stipulate within a premarital agreement. If any of the listed points apply to you now or in the future, you should consider creating a premarital agreement during a time when you and your intended spouse have the greatest chance of cooperative negotiation.

While a premarital agreement can offer benefits for any couple planning nuptials, many couples believe entering into this type of contract indicates they lack confidence in the survival of their marriage. But just as couples need to agree on whether to have children, some circumstances require similar agreements to help ensure a successful marriage.
